1. The spouse and I could no longer continue with the marriage and both of us wanted a divorce. What should we do?- It is advisable that both of you seek assistance from a lawyer of your own choice (or us). Consider filing for a Joint Petition for Divorce.
2. Joint Petition for Divorce? What is that?A Joint Petition for Divorce is an application filed jointly by you and your spouse, in which both parties have mutually agreed on the terms of the divorce and any related arrangements.
3. Are there any conditions before the spouse and I can file the Joint Petition?Yes, there are four key requirements:
1. The marriage must be registered under Malaysian marital law.2. The marriage must be monogamous.3. At the time the petition is filed, both you and your spouse must be residing in Malaysia.4. The marriage must have lasted more than 2 years.
4. What are the documents should I bring along with me before I go and meet my lawyer?Bring copies of both your and your spouse's IC, the marriage registration certificate, children's birth certificates (if applicable), and any documents related to matrimonial assets (if applicable). Your lawyer may not need all of them, but it's a good idea to have them on hand in case any are required.

6. My marriage has yet to reach the two year old threshold. Can the spouse and I file a Joint Petition?No, unless you have permission from the Court.
7. If my marriage exceeds the 2 year old threshold, do I still need to attend the conciliation process?No.
8. The marriage conciliation process, how do I initiate that?The simplest way is to visit a nearby JPN office. Bring copies and the originals of your IC, passport, marriage registration certificate, and police report (if applicable), along with some cash for any necessary payments. Obtain a JPNKC 14 form, fill it out, pay the required fees, and submit everything to the attending officer.
9. How long does the conciliation process takes?Around 6 month or less.
10. Who should be attending the conciliation process?It is recommended that both you and your spouse attend the process in person. However, with the necessary permission from the Marriage Tribunal or the conciliatory body, either of you may be represented by a family member. Lawyers are not allowed to represent either party.
11. What will happen if the Spouse refuses to attend the conciliation session?If a spouse refuses to attend the conciliation process, the Marriage Tribunal will make the necessary determination, and the conciliation process may be exempted.
12. What will happen if the conciliation process fails?The Marriage Tribunal will issue a certificate confirming that the conciliation process has failed and will provide recommendations regarding the division of matrimonial assets, alimony / maintenance, and child custody.
13. I wanted a Divorce but the Spouse is very much against it. Can I still file for Divorce?- Yes. But it's going to be a little bit complicated.
14. What are the grounds for Judicial Separation?- Breakdown of marriage.
15. Breakdown of marriage, what does it mean?- There are four grounds for breakdown of marriage:i. Your spouse commits adultery;ii. Unreasonable behavior of spouse;iii. You have been deserted for a period of two years or more by your spouse;iv. You and your spouse have been living separately for a period of two years of more.
16. My spouse is an alcoholic, abusive, or has a gambling addiction, and I can no longer bear to be with him. Can I file for divorce?-Yes, you can.
17. If I file for a Judicial Separation, do I need to attend the conciliation process?- Yes.
18. Does the spouse and I need to attend the hearing of the Petition?- Yes.
19. What happens after the hearing of the Petition?- If the Court is satisfied, it may issue a Decree Nisi, a provisional divorce decree that will remain valid for the next 3 months.
20. After Decree Nisi is granted, can I get back together with my spouse?- You may apply to have the Decree Nisi rescinded within 3 months of its issuance if you intend to reconcile.
21. Right after the expiry of the 3 month period for the Decree Nisi, can I or the spouse file an application to make the Decree absolute?- Yes.
22. Can I remarry my spouse after the Decree Absolute has been granted?- If the appeal period for the Decree has expired, or if your appeal has been dismissed, you are permitted to remarry your spouse.
